SJPD says the allegation of rape at McDonald’s house was reported Tuesday, and a judge signed the search warrant the same day. McDonald is the alleged suspect.

49ers general manager Trent Baalke announced the termination of McDonald’s contract.

SJPD’s statement:

The NFL reportedly says it is aware of the allegations against McDonald and is “looking into it.” 

The San Jose Police Department Sexual Assaults Investigations unit was notified and responded to conduct follow-up investigation. Based on preliminary investigation, detectives secured a search warrant and served it at the alleged suspect’s residence in San Jose. 

No arrests have been made. The investigation is active and on-going."

In a separate incident, the Santa Clara County District Attorney’s Office last month announced that there would be no charges filed against McDonald following an arrest Aug. 31 on suspicion of felony domestic violence.

Prosecutors in that case said they had insufficient evidence to charge McDonald. The 49ers claimed to have enough evidence to convince them to stand by McDonald even after NFL commissioner Roger Goodell announced that the penalty for domestic violence incidents would be dramatically stiffened.

McDonald, San Francisco’s third-round draft pick in 2007, lives in San Jose. He’s accumulated 19.5 sacks and 154 tackles through his eight-year career.

McDonald is the first potential case to be viewed under the NFL’s new personal conduct policy.
